What is a Board of Variance?

The Board of Variance holds formal hearings and makes decisions on minor variances to the Zoning, Building or Development Procedures Bylaws.  It is a body made up of three resident members appointed by Council, but operates independently of Council.  The authority given to a Board is outlined in BC’s Local Government Act, Division 15. 

The Board only considers minor variance applications which will not have an adverse impact on the wording or intent of a bylaw, nor on the subject property, neighbouring properties or services, or the natural environment.

When does the Board of Variance meet?

The Board of Variance meets when applications require review and therefore it does not have a regular meeting schedule. Board of Variance hearings are public meetings and open to attendance by residents.  Agendas and minutes for Board of Variance meetings will be available on our Document Centre in the near future and will be linked here.

How do I apply for a variance?

A person may apply for a minor variance if they feel compliance with the relevant bylaw would cause them hardship.  For example, if a large rock on their property would prevent the owner from siting a house as required by the Zoning Bylaw, a person could apply for a minor variance.

The Board may grant a variance if they have considered the facts presented and find the proposed variance does not:

  • Result in inappropriate development of the subject property;
  • Substantially affect the use and enjoyment of neighbouring properties or adjacent land;
  • Adversely affect the natural environment;
  • Vary permitted uses and densities; or
  • Defeat the original intent of a bylaw.
